ARTICLE 1 - INTRODUCTION

1.1 Overview

These General Terms and Conditions of Sale (hereinafter "GTC") are offered by Atelier Badaboum (hereinafter "Atelier Badaboum" or "we"), represented by Madame Sara DRIF and registered with the Paris Trade and Companies Register under number 942 372 145, with its registered office located at 102 Rue Saint-Maur - 75011 Paris.

1.2 Purpose

These GTC govern all contractual relations between Atelier Badaboum and any person making a purchase on the website accessible at www.atelier-badaboum.com (hereinafter "the Site") or by any other means (hereinafter "the Customer" or "you").

The GTC apply to all products sold by Atelier Badaboum via the Site, namely children's clothing and accessories, home linen, and nursery accessories (hereinafter "the Products").

1.3 Acceptance of the GTC

Any order placed on the Site implies the Customer's full and unreserved acceptance of these GTC. The GTC prevail over any other contractual document. Atelier Badaboum reserves the right to modify the GTC at any time. The applicable GTC are those in force on the day of the order.

ARTICLE 2 - PRODUCTS AND AVAILABILITY

2.1 Product Characteristics

The Products offered for sale are those displayed on the Site on the day of its consultation by the Customer, within the limits of available stock. Photographs and illustrations are provided for informational purposes only and are not contractually binding. Atelier Badaboum strives to present the Products as faithfully as possible, but slight variations in shade, texture, or cut may exist between the visuals displayed online and the delivered Product, particularly due to the natural materials used or display settings. These differences do not constitute a lack of conformity.

2.2 Product Availability

Product offers and prices are valid as long as they are visible on the Site and within the limits of available stock. In the event of a Product becoming unavailable after you place your order, we will inform you by email as soon as possible. You can then choose between:

  • A full refund for the unavailable Product
  • An exchange for another Product of equivalent value
  • Maintaining the order with an extended delivery time if the Product is temporarily unavailable

In case of a display error or computer stock malfunction, Atelier Badaboum reserves the right to cancel an order, even after confirmation, and will issue a refund without further compensation.

For fairness and to ensure optimal Product availability for all our customers, Atelier Badaboum reserves the right to limit the quantity of Products that can be purchased by a Customer in a single order.

2.3 Access conditions and purchase restrictions

Purchases on our Site are exclusively reserved for adults (at least 18 years old). By accepting these GTC, you declare and guarantee that you are at least 18 years old. Atelier Badaboum cannot be held responsible for any false declaration regarding the age of users.

2.4 Fight against unauthorized resale

Atelier Badaboum reserves the right to cancel or reject any order that appears to have been placed by unauthorized professional resellers or distributors. Our Products are intended for personal use and not for resale. Any order presenting characteristics suggesting an intention for commercial resale may be cancelled without prior notice.

ARTICLE 3 - PRICE AND PAYMENT

3.1 Price

Product prices are indicated in euros and include all taxes (TTC), excluding delivery charges. Delivery charges are indicated before the final validation of the order. The total amount due by the Customer is indicated on the order confirmation page.

Atelier Badaboum reserves the right to modify its prices at any time, it being understood that Products will be invoiced on the basis of the rates in force at the time of order validation.

3.2 Payment Methods

Orders can be paid for using the following payment methods:

  • Credit card (Visa, MasterCard, American Express)
  • PayPal
  • Apple Pay / Google Pay (depending on device compatibility when ordering)
  • Gift card: valid for one year from its purchase date on our site. The Customer can use it in one go or split it into several payments, and supplement the amount of their order with any other payment method accepted by our site.

Payment is due immediately on the date of the order. Payment data is exchanged in an encrypted manner using the SSL protocol and is never transmitted unencrypted over the network.

3.3 Retention of Title

Atelier Badaboum retains full and complete ownership of the Products sold until full payment of the price, including principal, fees, and taxes.

ARTICLE 4 - ORDER

4.1 Order Placement Steps

To place an order, you must follow these steps:

  1. Add your chosen Products to the cart
  2. Create a customer account or log in if you already have one
  3. Validate the contents of your cart
  4. Choose the delivery method and enter the delivery address
  5. Accept these GTC
  6. Proceed to payment

4.2 Order Confirmation

Once payment has been made, an order confirmation email will be sent to the email address provided during account creation, if it is free of errors. This email will include a summary of your order and a reference number. We recommend that you keep this email.

4.3 Order Modification or Cancellation

Once the order has been validated and payment made, you will no longer be able to modify or cancel your order, except within the framework of exercising your right of withdrawal as defined in Article 7.

Atelier Badaboum reserves the right to refuse an order in case of suspected fraud or unusual activity on the customer account. We also reserve the right to refuse any new order from a customer who has abused their right of withdrawal (frequent returns, used or damaged products, etc.).

In case of an obvious error in the displayed price (ridiculously low price, computer bug), Atelier Badaboum reserves the right to cancel the order, even after confirmation, and will proceed with a refund.

ARTICLE 5 - DELIVERY

5.1 Delivery Zone

Atelier Badaboum delivers to mainland France and the following countries: Germany, Austria, Belgium, Denmark, Spain, Estonia, Finland, Hungary, Italy, Latvia, Lithuania, Luxembourg, Norway, Netherlands, Poland, Portugal, United Kingdom, Slovakia, Sweden, Switzerland. Delivery times and costs vary depending on the destination and the chosen delivery method. 

If you reside in an area not listed above and wish to place an order, please do not hesitate to contact our customer service.

5.2 Preparation and Shipping Times

Orders are carefully prepared within 1 to 5 working days following the validation of your order.

During promotional periods, sales, or peak times, this delay may be extended up to 7 working days. In this case, Atelier Badaboum will inform the Customer by email.

5.3 Delivery Times

Once your order has been shipped, delivery times are generally as follows:

  • Mainland France:
    • Standard home delivery: 2 to 4 working days
    • Express delivery: 1 to 2 working days
  • Europe: 5 to 10 working days
  • International: 7 to 15 working days

The indicated times begin from the shipment of the order, confirmed by email. Atelier Badaboum cannot be held responsible for consequences due to a delivery delay beyond its control (bad weather, strikes, epidemics, etc.).

Delivery times are provided for informational purposes only. No refund will be due in case of delay beyond our control.

Certain items, particularly those from new productions or restocks, may be subject to a specific shipping delay mentioned on their product page.
In this case, the order will be shipped from the date indicated on the product page, even if other items in the order are available immediately.

In the event of an order including both a pre-shipment item and an in-stock item, the entire order will be shipped in a single consignment, unless otherwise indicated by Atelier Badaboum.

The announced delivery times (2 to 4 working days for France, etc.) then begin to run from the effective shipping date of the order.

5.4 Available Delivery Methods

Atelier Badaboum offers several delivery methods:

  • Home delivery with tracking
  • Delivery to a relay point
  • Express home delivery

Shipping costs for orders are borne by the Customer and vary depending on the chosen shipping method and destination. They are communicated to you before the final validation of your order.

In case of delivery to a relay point, the Customer is responsible for collecting their package within the timeframe set by the carrier. If the package is not collected within this timeframe and is returned to Atelier Badaboum, the return costs will be borne by the Customer. Atelier Badaboum cannot be held responsible for the Customer's failure to collect the package, nor for any consequences arising therefrom, including additional re-shipping costs. In this case, the Customer must contact our customer service to arrange a new delivery at their expense or request a refund for the products, from which the return costs will be deducted.

For any order exceeding €150, Atelier Badaboum offers free delivery in metropolitan France. The shipping method will be selected at our discretion.

From May 2 to 9, 2026, Atelier Badaboum offers free delivery in mainland France for any order placed on the site. This offer exclusively concerns shipments made via the Mondial Relay service.

The offer is automatically applied upon validation of the order and is not subject to any minimum purchase.
It does not apply to deliveries to other destinations, nor to other shipping methods offered.

This promotion is valid during the indicated period, within the limits of the company's processing and shipping capacities. It is non-refundable, non-exchangeable, and cannot be subject to any financial compensation.

5.5 Delivery Address and Responsibility

Products are delivered to the delivery address indicated by the Customer when placing the order. The Customer is responsible for the accuracy and completeness of the delivery information they provide to Atelier Badaboum, including the full address, any access code, and specific delivery instructions.

Atelier Badaboum cannot be held responsible for consequences resulting from erroneous or incomplete information (delivery delay, delivery to a wrong address, returned package, etc.). In the event that an input error necessitates a new shipment, all costs incurred for re-shipping the order will be entirely borne by the Customer.

In case of an order sent to a third party (gift), the Customer remains solely responsible for the correct receipt and conformity of the delivery details. No refund will be granted in case of refusal of the package or dispute with the recipient, except for product defects.

5.6 International Deliveries and Customs Fees

For deliveries outside the European Union, customs duties, local taxes, import duties and/or state taxes may be payable. These duties and taxes are the sole responsibility of the Customer and fall under their full responsibility both in terms of declarations and payments to the competent authorities and bodies of the delivery country.

Atelier Badaboum is not obliged to inform the Customer of the customs duties, taxes or import fees applicable in the delivery country. The Customer is invited to inquire with the competent authorities in their country before placing an order.

Customs duties and various taxes payable are to be paid directly to the carrier or customs authorities upon delivery. Any package refused upon delivery or returned due to non-payment of these fees will incur return costs that will be deducted from any refund. If no right of withdrawal is exercised, no refund will be made.

5.7 Order Tracking

An email containing a tracking link will be sent to you as soon as your order is shipped. For any questions regarding the tracking of your package, you can contact us by email at contact@atelier-badaboum.com specifying your order number.

5.8 Receipt of Products

Atelier Badaboum carefully packages ordered Products, ensuring the quality and protection of the items. The Customer is responsible for checking the condition of the order upon delivery, in the presence of the carrier, and for making any necessary reservations on the delivery note. In case of a damaged package or doubt about its integrity, the Customer is invited to refuse delivery and return the package in its original packaging.

If an anomaly is found after delivery, the Customer must inform Atelier Badaboum by email at contact@atelier-badaboum.com, within 48 hours of receipt, with supporting photos.

ARTICLE 6 - WARRANTIES

6.1 Legal Guarantee of Conformity

In accordance with articles L.217-4 et seq. of the Consumer Code, you benefit from a legal guarantee of conformity for Products presenting a lack of conformity existing at the time of delivery. This guarantee allows you to obtain free repair or replacement of the non-conforming Product within two years from the delivery of the Product.

6.2 Warranty against hidden defects

In accordance with articles 1641 et seq. of the Civil Code, you also benefit from a warranty against hidden defects that render the Product unfit for its intended use, or that diminish this use to such an extent that you would not have acquired it, or would have paid a lower price for it, had you known of them. This action must be brought within two years from the discovery of the defect.

6.3 Exclusions from warranty

Warranties do not cover defects or deteriorations caused by abnormal use or use not in accordance with the instructions for use and maintenance, negligence, normal wear and tear, or an accident.

ARTICLE 7 - RIGHT OF WITHDRAWAL AND RETURNS

7.1 Withdrawal period and procedures

In accordance with current legislation, you have a legal right of withdrawal of 14 days without having to provide any reason. This period runs from:

·       the date of receipt of the Products at the delivery address you indicated (or in case of failed delivery, from the date of first presentation of the package)

·       the day you receive email and/or SMS notification that your order is available at the chosen Pickup Point, if you opted for this delivery method

To exercise this right, please clearly inform us of your decision to withdraw via our contact form or by email at contact@atelier-badaboum.com. Following your request, we will provide you with a return voucher that must accompany your package. Without this document, Atelier Badaboum may refuse the return or suspend the refund until your order is fully identified.

For your withdrawal to be valid, items must be returned in their original condition and packaging, unworn, unused, and with their labels still attached.

All products on the site can be returned, with the exception of personalized items and those bearing a special mention. Sale items, promotional items, or limited edition items are neither refundable nor exchangeable, except in the case of a defect or the exercise of the legal right of withdrawal within the prescribed deadlines.

Please note that any damaged, worn, washed, incomplete product, or product whose original packaging is deteriorated, cannot be refunded.

Some Products may be offered for pre-order. The delivery time will be specified on the product sheet and cannot give rise to a claim or request for early refund.

We inform you that we are unable to carry out direct product exchanges. If you wish to obtain a different item, we recommend that you return your initial order according to our standard return procedure, then place a new order for the desired item.

Extended Returns – Christmas Period

By way of derogation from the legal withdrawal period of 14 days, Atelier Badaboum grants an extended return period for orders placed between December 3, 2025 and December 24, 2025.

The affected items may be returned until January 31, 2026 inclusive, under the usual return conditions (products unworn, unwashed, in their original condition).

7.2 Return of Products

Return shipping costs, including any customs fees, are entirely at your expense. We draw your attention to the fact that the shipment of the return package is your responsibility. We strongly recommend that you keep all proof of shipment as proof of return and take out insurance.

In the event of a total return of your order, any product offered or received free of charge must also be returned with the purchased items.

7.3 Refund and Credit Note

Please note that the refund will only be processed after receipt and verification of the returned product.

In accordance with the law, the refund will be made via the same payment method used for the initial order. However, the Customer may choose to receive a credit note of the same amount, valid for 6 months, by making an express request to our customer service. This credit note can be combined with ongoing promotions and can be used multiple times. The credit note will not be refundable or exchangeable for cash.

The refund will only cover the price of the returned products. Initial delivery charges will not be refunded, except in the case of an order preparation error or a defective product.

For Customers residing in metropolitan France and who did not benefit from free delivery, the credit note also includes the reimbursement of the initial shipping costs invoiced when the order was sent.

In case of payment by gift card, the refund can only be made by issuing a new gift card.

ARTICLE 8 – DISCOUNT AND PROMOTION POLICY

Our company philosophy opposes overconsumption practices encouraged by seasonal promotions. We prioritize limited and responsible production, adjusted as closely as possible to actual demand. The prices we offer reflect the fair value of our creations, their quality, and our ethical commitment. If we occasionally offer discounts, it is a thoughtful approach and not a commercial logic of constantly renewing collections.

Atelier Badaboum reserves the right to apply, at its sole discretion, occasional discounts on certain items. These reductions do not constitute a permanent commitment or an obligation to maintain reduced prices over time. The Client is informed that these discounts are temporary and applied according to the conditions determined by Atelier Badaboum. These promotional operations do not fall within the scope of regulated sales and do not follow a predefined schedule.

ARTICLE 9 - LIABILITY

9.1 Limitation of Liability

Atelier Badaboum's liability can only be invoked in the event of proven fault on its part. Atelier Badaboum cannot be held responsible for the non-performance of the contract in the event of force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communication.

9.2 Use of the Site

Atelier Badaboum does not guarantee that the Site will be free of anomalies, errors, or bugs, nor that these can be corrected, nor that the Site will operate without interruption or breakdown, nor that it will be compatible with a particular hardware or configuration.

Atelier Badaboum reserves the right to temporarily interrupt access to the Site for maintenance, updates, or technical malfunctions, without prior notice or compensation.

ARTICLE 10 – FORCE MAJEURE

Atelier Badaboum's liability cannot be invoked if the non-performance or delay in the performance of one of its obligations described in these general terms and conditions of sale results from a case of force majeure.

In this respect, force majeure is understood to mean any external, unforeseeable and irresistible event within the meaning of Article 1218 of the Civil Code, independent of our will and beyond our reasonable control.

Cases of force majeure notably include, but are not limited to: natural disasters, fires, floods, storms, total or partial strikes, epidemics, pandemics, blockages of transport or supply means, interruptions or malfunctions of electrical or telecommunication networks, legal or regulatory changes, or any other circumstance beyond the reasonable control of Atelier Badaboum.

In the event of a force majeure event, Atelier Badaboum will inform the customer as soon as possible. The performance of Atelier Badaboum's obligations will then be suspended for the entire duration of the force majeure, and will resume its course upon its cessation. If the impediment is permanent, the contract will be terminated and the parties will be released from their obligations under the conditions provided by law.

ARTICLE 11 - INTELLECTUAL PROPERTY

All content present on our site (texts, comments, illustrations, images, photos, videos, logos, graphic elements, sound elements, as well as all computer and technical systems used) is protected by copyright and intellectual property rights worldwide.

In accordance with the Intellectual Property Code, only strictly private use is authorized; any other use not expressly authorized by Atelier Badaboum may constitute an infringement of the brand's intellectual property rights. The total or partial reproduction of our catalog is strictly prohibited, and any link to our site from a third-party site requires our prior written authorization, which may be revoked at any time upon our simple request. ARTICLE 12 - PERSONAL DATA

Atelier Badaboum undertakes to respect the confidentiality of personal data communicated on the Site and to process them in accordance with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Law n°78-17 of January 6, 1978, relating to data processing, files, and freedoms, as amended. ARTICLE 13 - DISPUTE RESOLUTION

13.1 Applicable law

These General Terms and Conditions of Sale are subject to French law. In case of translation, only the French version shall prevail in case of interpretation.

13.2 Mediation

In the event of a dispute, the Client must first contact Atelier Badaboum's customer service at the following address: contact@atelier-badaboum.com.

Should an amicable solution not be found directly with Atelier Badaboum within two months from the complaint, or in the absence of a response from customer service within the same period, the Client has the option to resort free of charge to the competent consumer mediator, within a maximum period of one year from their initial complaint.

In accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission also provides consumers with an Online Dispute Resolution (ODR) platform, accessible at the following address:https://consumer-redress.ec.europa.eu. This platform facilitates the out-of-court and independent resolution of online disputes between consumers and professionals established in the European Union.

13.3 Competent Jurisdiction

In the absence of an amicable agreement, the dispute will be submitted to the competent French courts in accordance with the rules of the Code of Civil Procedure.

ARTICLE 14 - PRE-CONTRACTUAL INFORMATION - CLIENT ACCEPTANCE

The Client acknowledges having received, prior to placing their order, in a clear and understandable manner, these General Terms and Conditions of Sale and all the information and particulars referred to in articles L111-1 to L111-7 of the Consumer Code.

ARTICLE 15 - MISCELLANEOUS PROVISIONS

15.1 Partial Nullity

If one or more stipulations of these General Terms and Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation, or following a final decision of a competent court, the other stipulations will retain their full force and scope.

15.2 Non-Waiver

The fact that one of the parties does not invoke a breach by the other party of any of the obligations referred to in these General Terms and Conditions of Sale shall not be interpreted for the future as a waiver of the obligation in question.

ARTICLE 16 – HOSTING

The Atelier Badaboum website is hosted by Shopify Inc., a Canadian company, whose registered office is located at 151 O’Connor Street, Ottawa, Ontario K2P 2L8, Canada.

ARTICLE 17 – VALENTINE'S DAY CONTEST

Atelier Badaboum is organizing a Valentine's Day contest on Instagram via its account @atelier.badaboum. The contest is open to all adults residing in metropolitan France. Participation is free and requires no purchase.

To participate, simply:
- follow the account @atelier.badaboum,
- like and save the contest post,
- invite at least 1 person in the post's comments (each additional comment offers an extra chance).
Optional: sharing the post in a story can improve the visibility of participation but is not mandatory.

Entries are accepted until February 20 at 11:59 PM. Any entry received after this deadline will not be considered.

A random draw will be conducted on February 21 among valid entries. The winner will be contacted via Instagram private message. If there is no response within 48 hours, a second draw may be performed. The prize consists of a Fluffy sweatshirt (white or grey, winner's choice). This prize is neither refundable, exchangeable for money, nor transferable.

The contest is neither sponsored, administered, nor associated with Instagram. Instagram cannot be held responsible for its conduct.

As part of the contest, only strictly necessary data (Instagram username and private message exchange with the winner) are used. Participants can exercise their rights of access, rectification, or deletion by writing to contact@atelierbadaboum.com. Data is neither retained beyond the contest nor transmitted to third parties.

Participation implies full acceptance of these simplified rules for the Atelier Badaboum Valentine's Day contest.
